What laws and regulations govern my water service?
Your water service is governed by the UAU Tariff and all applicable federal, state, and municipal laws. The Regulatory Commission of Alaska (RCA) approves the tariff and enforces compliance.
Your water service is regulated by multiple levels of government to ensure safe and reliable service.
What governs your water service
The UAU Tariff:
- Contains all rules, rates, and procedures for water service
- Approved by the Regulatory Commission of Alaska (RCA)
- All utility services and facilities are subject to this tariff
- Remains in effect until changed according to law
- If a provision is ruled invalid, the rest of the tariff remains in effect
Federal, state, and municipal law:
- All utility services and facilities are also subject to federal, state, and municipal laws
- The utility must provide water that meets current Alaska Department of Environmental Conservation (ADEC) water quality standards
Special contracts
Some customers may have special contracts with different terms than the tariff. These contracts must be approved by the RCA.
How the tariff is enforced
The utility may enforce the tariff by:
- Applying to the RCA for enforcement action
- Seeking civil penalties, injunctive relief, or criminal sanctions
- Discontinuing or disconnecting water service as provided in the tariff
The utility does not need a criminal conviction before discontinuing or disconnecting service.
Regulatory Commission of Alaska (RCA)
The RCA regulates public utilities in Alaska, including approving tariffs and rates and investigating customer complaints. The RCA was established on July 1, 1999.
